Terms & Conditions for Nas Design Company
Content Writing Services
- Nas Design Company will create written material for the Client’s website as per the Client's request and agreed-upon terms.
- Nas Design Company will exercise reasonable care to ensure accuracy in all facts and statements and will not infringe upon any copyright or third-party rights.
- The Client retains the right to edit the content within the agreed-upon timeframe, and Nas Design Company will collaborate with the Client in editing and reviewing the content before publication.
- The Client is responsible for thoroughly reviewing the final draft for accuracy, including spelling, grammar, and content. Nas Design Company is not responsible for errors discovered after the website is live.
Web Design and Development Services
- Nas Design Company will design and develop a website as per the Client's specifications and will deliver the project according to the agreed-upon conditions.
- The Client is responsible for outlining the website structure, number of pages, and other pertinent specifications.
- The Client will provide Nas Design Company with appropriate photography or imagery for use in the design.
- The Client must procure and purchase a domain name. Nas Design Company may provide guidance on suitable names at its discretion.
- The Client acknowledges that any errors, grammatical or otherwise, found in the material provided by the Client are not the responsibility of Nas Design Company.
- Nas Design Company agrees to address errors or implement revisions requested by the Client, up to a maximum of three revisions (based on the package). Major design changes are not included in the revision process.
- Change requests made after final approval has been granted to Nas Design Company or after the website is live will incur additional charges. Nas Design Company will commence work on subsequent change requests only upon receipt of full payment.
- The Client understands that Nas Design Company will include a "Web Design by Nas Design Company" link in the footer section of each website for branding purposes. Removal of this link will incur an additional charge.
- Due to the nature of business, Nas Design Company will not be held liable for any website hacking, loss of rankings, or errors.
- The Client can cancel website development or digital marketing projects if Nas Design Company's team has not commenced work and no cancellations will be accepted after 1 calendar day.
- After the website is live, paid support will be provided at the rate of 2000 Rs + 18% GST.
Logo and Graphic Design Services
- Nas Design Company aims to create unique logos and provides recommendations based on research and concept building. Alternate logo designs will be offered if a trademark on the logo is rejected for any reason.
- Should issues arise during trademark registration, the Client may contact Nas Design Company for alternative design options. However, the absolute certainty that the chosen design is entirely distinct from existing designs is nearly impossible.
- Please note that any terms agreed upon in the final proposal or email will also be considered alongside the terms mentioned in this document.
- Design Creation: Our team will create initial design concepts based on the information and preferences provided by the client.
- Revisions: We offer a specific number of revisions based on the chosen package. Additional revisions may incur extra charges.
- Finalization: Upon approval of the final design, the client will receive the completed design files in the agreed-upon formats.
Client Responsibilities:
1. Information and Feedback: The client is responsible for
providing clear and comprehensive information, feedback, and any necessary
materials required for the design process.
2. Timely Response: Prompt responses and feedback from the
client regarding design concepts and revisions are crucial for the timely
completion of the project.
3. Design Formate: Size, layout and other design requirements need to be shared before starting the work. Additional revisions may incur extra charges.
Design Ownership:
The finalized design, upon full payment, will be the
intellectual property of the client. Nas Designz retains the right to
showcase the work in portfolios and marketing materials.
Third-Party Elements:
If the design includes elements sourced from third parties
(such as stock images or fonts), the client is responsible for adhering to the
usage rights and any associated fees for those elements.
Payment and Refunds:
1. Payment: An upfront deposit or full payment is required
before the commencement of the design work.
2. Refunds: Once the design process has begun, refunds are not typically provided. However, we strive to ensure client satisfaction and will address concerns to the best of our abilities.
3. Invoice Payment Deadline
Payment for the invoice must be received within two (2) days from the date of issuance. Failure to submit payment within this timeframe may result in additional charges.
4. Late Payment Interest
A late payment interest charge of 10% per month will be applied to invoices not settled within the specified payment period. This interest will accumulate on the outstanding balance until the payment is received in full.
4. Advance Payment for Above ₹500 Rupee Works
For projects exceeding ₹500 Rupees, a 50% advance payment is required before commencement. The advance payment ensures the initiation of work and commitment to the project.
Project Timelines:
We commit to completing design projects within agreed-upon
timelines, provided the client adheres to the scheduled review and feedback
process.
Client Approval:
The client's approval of the final design is considered an
acceptance of the work's completion. Subsequent change requests will be charged
additionally.
Limitation of Liability:
Nas Designz is not liable for any loss, damage, or legal
issues arising from the use of the finalized design post-delivery.
Modification of Terms:
Nas Designz retains the right to modify these terms and
conditions. Clients will be informed of any changes.
Agreement:
By engaging our services, the client agrees to these terms
and conditions.
